# You Can't Just "Move to a Blue State" Anymore: Health Care Is Now a Relocation Variable

For years, the relocation shorthand for families with a trans kid, a trans parent, or a trans grandparent went something like this: move to a blue state, and the care will be there.

In the span of six days this September, three separate developments showed why that shortcut no longer holds on its own. A string of major hospital systems ended care in states where it is legal. California, the presumed safe harbor, vetoed a bill to lock in one of its protections. And a federal rule that follows clinics into every state landed in front of a judge.

Advocacy outlets have covered this as a rights story, and it is one. Relocation guides have mostly not covered it at all. We think it belongs in the same spreadsheet as jobs, schools, and cost of living. This is not a panic piece. It is a planning piece.

## What changed in 11 Days

Here is the short version, in order. We will take each one in turn below.

## Four of the Six Were in States Where the Care Is Legal

On September 23, The Advocate published [its accounting](https://www.advocate.com/politics/national/hospitals-millions-trump-trans-care?ref=qfamilyway.com): since May, at least six hospital systems have signed agreements with the U.S. Justice Department to end gender-affirming care for minors, paying at least $24.3 million combined. Not every payment was made public, so the real total is likely higher.

Look at where those systems sit. Two of them, in Texas and Ohio, are in states that already restrict this care for minors. The other four are in New York, Connecticut, and Pennsylvania, where the care is legal under state law.

That is the shift. **State law protected the care. It did not protect the program.**

To report this fairly: [the Justice Department says](https://www.justice.gov/opa/pr/doj-secures-agreements-nyu-and-upmc-end-pediatric-gender-affirming-care?ref=qfamilyway.com) the agreements address fraudulent billing practices. The hospitals have not admitted wrongdoing, and NYU Langone said in a statement that it "affirmatively denied any wrongdoing or liability." Some systems said they signed to bring long federal investigations to an end. Advocacy groups, including Lambda Legal, called the deals a capitulation. All of that can be true at the same time, and none of it changes the practical outcome for a family whose clinic just closed.

The lesson for planning is simple: a hospital that depends on federal money can be moved by federal pressure, no matter which state it sits in.

## California What Actually Happened

On September 20, Governor Gavin Newsom [vetoed AB 2164](https://www.ebar.com/story/170505?ref=qfamilyway.com). The bill would have written into state law a ban on honoring extradition requests from other states for people who provide, receive, or help with abortion or gender-affirming care that is legal in California.

It is worth being precise about why, because the headlines were not always precise. Newsom did not object to the care. His veto message objected to the structure: the bill "would prohibit future governors from recognizing a request for extradition," and he wrote that he was troubled by an outgoing administration agreeing with the Legislature to "erode the executive authority of an incoming Governor."

Here is what that means in practice:

- **California's existing protections stay in place.** The 2022 law that made California a refuge state for gender-affirming care, including limits on out-of-state subpoenas and court orders, is still on the books.
- **The extradition piece now depends on who is governor.** Newsom is termed out, and Californians elect his successor on November 3\. [Eighteen other Democratic-led states](https://www.motherjones.com/politics/2026/09/newsom-vetoes-bill-that-would-ban-extraditions-for-abortion-and-gender-affirming-care/?ref=qfamilyway.com) have written extradition protections into law. California has not.

You can respect a governor's reasoning and still note what it leaves exposed. For a family planning a multi-year move, "protected by statute" and "protected by the current governor's discretion" are two different levels of certainty.

## The Federal Layer Follows Everywhere

The third change is the one relocation cannot solve.

The Ryan White HIV/AIDS Program funds HIV care clinics across the country. The federal government has attached a condition to that funding: clinics that take it cannot acknowledge transgender identities in their policies or provide gender-affirming care. A coalition of HIV providers and medical associations, represented by Lambda Legal, [sued](https://www.lambdalegal.org/case/american-academy-of-hiv-medicine-v-hrsa/?ref=qfamilyway.com).

At a hearing on September 23, U.S. District Judge William Young in Massachusetts [appeared open to blocking the rule](https://www.advocate.com/politics/national/trump-hiv-transgender-restrictions?ref=qfamilyway.com), questioning whether it interferes with the doctor-patient relationship and burdens providers' speech. A ruling is pending.

Why this matters for a move: a federal funding condition applies to a clinic in Oakland exactly the way it applies to a clinic in Oklahoma City. If someone in your family is trans and relies on a Ryan White-funded clinic, which state you live in does not change the rule. The ruling will.

## The New Map Has Five Layers

The old heuristic checked one thing: the state. Care access now runs through five layers, and a gap in any one of them can close a door the others left open.

5 · Your provider and your backup Do we have records in hand, a second provider, and a telehealth or cross-state option if a door closes?

## If a Move Is on Your Mind

None of this means "don't move." It means move with better questions.

**Put care access on** [**the same list as jobs, schools, and rent**](https://qfamilyway.com/blog/best-worst-states-for-lgbtq-families-2026/)**.** Not as a footnote at the end. If a family member needs ongoing care, it is a first-tier variable.

**Research the system, not just the state.** Before you fall for a city, find out which health systems serve it, whether any of them have signed federal agreements or paused programs, and what independent clinics or community health centers are within reach.

**Call before you sign a lease.** Ask a prospective provider directly: are you accepting new patients, and what is your plan if your program changes? A good provider will not be offended by the question.

**Carry your records.** Keep copies of medical records, prescriptions, and letters from current providers. If a program closes, having your records in hand can shorten the gap.

**Know your backup.** Identify a second provider, a telehealth option licensed in your state, or a system across a state line that you could reach if you had to.

## The Map Moves Both Ways

It would be easy to read all of this as a map that only shrinks. It is not.

On September 12, Hungary's new prime minister, Péter Magyar, [announced](https://www.euronews.com/my-europe/2026/09/13/peter-magyar-announces-upcoming-changes-to-child-adoption-regulations-for-singles-and-same?ref=qfamilyway.com) that his government will change the adoption rules put in place under Viktor Orbán in 2020\. Those rules required ministerial approval for single applicants, which in practice shut same-sex couples out of adoption. Magyar said the decision should rest with child-welfare professionals, "not the minister, a politician." Parliament is now debating a broader child-protection bill.

Stay grounded about it. The law has not changed yet, same-sex marriage is still not legal in Hungary, and the details are still being written. But a country that closed a door six years ago is actively working to reopen it.

That is the real lesson of this month's map. Places change, in both directions, and sometimes quickly. The families who do best are the ones watching the actual laws, not the reputation. ## The Bottom Line

"Move to a blue state" was never a full plan. This month made that plain.

The better plan looks at five layers instead of one, asks direct questions before signing anything, and keeps a backup in reach. That is more work, and it is also more power. You do not have to wait for the map to settle to start planning well.
